1. Acceptance of Terms

By downloading, installing, or using Meta Caddie ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legal agreement between you and 1Putt Health ("we," "us," "our," "the Company"). By tapping "Agree," creating a subscription, or otherwise using the App, you confirm that you have read, understood, and accepted these Terms.

You must be at least 13 years old to use the App (16 in the European Union). By using the App, you represent that you meet this age requirement.

2. Description of Service

Meta Caddie is an AI-powered golf caddie application for iPhone, with companion support for Apple Watch and Ray-Ban Meta smart glasses. The App provides:

• AI caddie advice including club recommendations, course strategy, and shot selection
• GPS-based yardages to greens, hazards, and layup targets
• Visual course assessment via Ray-Ban Meta glasses camera (on demand)
• Voice interaction via on-device speech recognition and AI-generated spoken responses
• Round tracking including scores, shot locations, and club selections
• Tournament Mode with restricted features for rules-compliant play
• Performance history and trend analysis over time

The App uses artificial intelligence (powered by Anthropic's Claude) to generate caddie advice and Fish Audio for text-to-speech voice output. AI-generated advice is informational only and subject to the disclaimers in Section 6.

3. Subscription Terms

3.1 Paid Subscription Required

Meta Caddie requires a paid subscription. There is no free tier. All new subscribers receive a 7-day free trial before billing begins.

3.2 Subscription Tiers

Prices are in US dollars and may vary by region. Applicable taxes are additional.

3.3 Billing and Renewal

• Subscriptions are billed through the Apple App Store via your Apple ID.
• Your subscription automatically renews at the end of each billing period unless you cancel at least 24 hours before the renewal date.
• Payment is charged to your Apple ID account at confirmation of purchase, or at the end of the free trial if you do not cancel beforehand.
• Your Apple ID account is charged for renewal within 24 hours prior to the end of the current period.

3.4 Free Trial

• New subscribers are eligible for one 7-day free trial.
• If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription at the rate of the plan you selected.
• Any unused portion of the free trial is forfeited upon purchasing a subscription.

3.5 Cancellation

You may cancel your subscription at any time through your Apple ID account settings or the App Store. Upon cancellation:

• You retain access to your subscription features until the end of the current billing period.
• No partial refunds are issued for unused time within a billing period.
• Your round history and profile data remain on your device after cancellation.

3.6 Refunds

All purchases are processed by Apple. Refund requests must be submitted directly to Apple through their support channels. We do not process refunds independently of Apple. See Apple's refund policy.

3.7 Price Changes

We may change subscription prices at any time. Price changes take effect at the start of your next billing period following notice. If you do not agree to a price change, you may cancel your subscription before the change takes effect.

4. User Responsibilities

By using the App, you agree to:

• Use the App safely. Do not use Meta Caddie in a manner that distracts you or others or creates a safety hazard. Always be aware of your surroundings on the golf course, including other players, maintenance equipment, and course conditions.
• Comply with course rules. Respect the rules and policies of the golf course you are playing, including any restrictions on electronic devices, pace of play, and cart path regulations.
• Comply with tournament rules. If you are playing in a sanctioned competition, you are solely responsible for understanding and following the applicable rules of golf regarding distance-measuring devices and AI assistance. See Section 15 for more details.
• Respect other players' privacy. When using camera or microphone features, be mindful of other golfers. Do not capture images or audio of other players without their knowledge or consent.
• Provide accurate information. The quality of AI caddie advice depends on the accuracy of your profile data (handicap, club distances, preferences). You are responsible for keeping this information current.
• Not misuse the service. You agree not to reverse-engineer, decompile, or disassemble the App; use the App for any unlawful purpose; attempt to circumvent subscription requirements; or use automated systems to access the App.

5. User Content and Data

5.1 Your Data

You retain ownership of all personal data you provide to the App, including your profile information, round history, and performance data. Your data is stored locally on your device. See our Privacy Policy for details.

5.2 AI Interactions

When you interact with the AI caddie, your queries and relevant context (yardage, weather, club distances, lie description) are transmitted to our AI provider (Anthropic) for processing. These queries are not stored by the AI provider beyond the duration of the request. Camera frames sent for visual analysis are processed and immediately discarded.

5.3 Feedback

Any feedback, suggestions, or ideas you voluntarily submit to us regarding the App become our property. We may use such feedback for any purpose without obligation or compensation to you.

6. AI Advice Disclaimer

This is important. Please read it carefully.

Meta Caddie provides AI-generated golf advice for informational and entertainment purposes only. The AI caddie is not a substitute for a professional golf instructor, a real caddie, or your own judgment.

• No guarantee of accuracy. AI advice is generated based on available data (GPS, weather, your profile, and visual input when available). It may be incorrect, incomplete, or inappropriate for your specific situation.
• Not professional instruction. Meta Caddie does not provide swing coaching, physical training advice, or medical guidance.
• Your shots are your responsibility. You are solely responsible for every shot you hit.
• Course data limitations. GPS yardages are approximate. Course maps and hazard locations may contain inaccuracies or may not reflect recent course modifications.
• Weather data limitations. Weather information is sourced from third-party providers and may not reflect micro-conditions at your exact location on the course.

YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT USE OF THE APP AND ANY AI-GENERATED ADVICE IS AT YOUR SOLE RISK.

7. Privacy

Your privacy matters to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

8. Third-Party Services

These services operate under their own terms of service and privacy policies. We are not responsible for the practices, availability, or performance of third-party services. A disruption in any third-party service may affect App functionality, and such disruptions do not entitle you to a refund.

9. Intellectual Property

9.1 Our Intellectual Property

Meta Caddie, including its design, code, AI prompts, user interface, graphics, icons, and audio content, is owned by 1Putt Health and is protected by copyright, trademark, and other intellectual property laws.

9.2 License Grant

Subject to your compliance with these Terms and your active subscription, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App on devices you own or control, solely for your personal, non-commercial use.

9.3 Restrictions

You may not:

• Copy, modify, or distribute the App or any portion of it
• Reverse-engineer, decompile, or disassemble the App
• Remove or alter any proprietary notices or labels
• Use the App to build a competing product or service
• Sublicense, lease, or lend the App to any third party
• Use our trademarks without prior written consent

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

1. NO WARRANTIES. THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

2. LIMITATION OF DAMAGES. IN NO EVENT SHALL 1PUTT HEALTH, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP.

3. MAXIMUM LIABILITY. OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify, defend, and hold harmless 1Putt Health and its officers, directors, employees, contractors, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of or inability to use the App, your violation of these Terms, or your violation of any applicable law or regulation.

12. Termination

12.1 By You

You may stop using the App at any time. Cancel your subscription through your Apple ID account settings. Uninstalling the App removes all locally stored data from your device.

12.2 By Us

We may suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Grounds for termination include violation of these Terms, abuse of the App, fraudulent or illegal activity, or circumvention of subscription requirements.

13. Dispute Resolution

Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court.

13.1 Informal Resolution

Before initiating any formal dispute resolution, you agree to contact us at support@1putthealth.com and attempt to resolve the dispute informally for at least 30 days.

13.2 Binding Arbitration

If we cannot resolve a dispute informally, you and 1Putt Health agree to resolve any claims relating to these Terms or the App through final and binding arbitration, except as set forth in Section 13.5. Arbitration shall be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules.

13.3 Class Action Waiver

YOU AND 1PUTT HEALTH AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

13.6 Opt-Out

You may opt out of the arbitration and class action waiver provisions by sending written notice to support@1putthealth.com within 30 days of first accepting these Terms.

13.7 Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Effective Date" at the top of these Terms and notify you through the App. Your continued use of the App after the effective date of updated Terms constitutes acceptance of those changes.

15. USGA and Tournament Compliance

15.1 Tournament Mode

Meta Caddie includes a Tournament Mode designed to restrict features that may not be permitted under the Rules of Golf. When Tournament Mode is enabled, features such as AI-generated club recommendations may be disabled.

15.2 Your Responsibility

Tournament compliance is entirely your responsibility. We make no representation or warranty that Tournament Mode fully complies with the rules of any specific competition. Before using Meta Caddie in any competitive round, you must verify that its use is permitted under the applicable rules.

16. General Provisions

These Terms, together with the Privacy Policy, constitute the entire agreement between you and 1Putt Health regarding the App. If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full force and effect.

Apple-Specific Terms

You acknowledge that these Terms are between you and 1Putt Health, not Apple. 1Putt Health, not Apple, is solely responsible for the App and its content. Apple is a third-party beneficiary of these Terms and may enforce them against you.
